Engineer Rashid moves Delhi court for interim bail to take oath after defeating Omar Abdullah in Lok Sabha elections
Sheikh Abdul Rashid also known as Engineer Rashid, has won Lok Sabha elections from Jammu Kashmir’s Baramull. He defeated the former Jammu and Kashmir’s Chief Minister Omar Abdullah by over two lakh votes. Rashid is currently in Tihar Jail facing charges under the Unlawful Activities Prevention Act (UAPA) in alleged terror-funding case. His victory has led to legal battle for interim bail. He needs this to take his oath as Member of Parliament (MP).
On Thursday Additional Sessions Judge (ASJ) Chander Jit Singh sought response. He asked from National Investigation Agency (NIA) regarding Rashid’s application for interim bail or custody parole. They need this to allow him to fulfil parliamentary duties. The court is scheduled to hear case further on Friday. Rashid’s lawyer, Vikhyat Oberoi has confirmed that they are seeking this bail. They aim to enable Rashid to take his mandatory oath before the President. This is stipulated by Article 99 of the Constitution. Additionally, perform other parliamentary functions.
Rashid’s victory in Baramulla constituency was unexpected. Despite being jailed since August 2019 Rashid’s electoral success has garnered attention. His campaign was managed by his sons Abrar Rashid and Asrar Rashid
Former Chief Minister Mehbooba Mufti lost her bid for Anantnag-Rajouri Lok Sabha seat. She appealed to central government to respect the voters’ verdict. “The government of India must respect the verdict of people. Release Engineer Rashid.” Mufti posted on X.
Rashid had been a Member of Legislative Assembly (MLA) from Langate Assembly in 2008 and 2014. He is founder of the Jammu and Kashmir Awami Ittehad Party. But he chose to contest as independent candidate in this election. His previous political experience and grassroot campaigning helped him secure this victory despite his legal challenges.
The political landscape in Jammu and Kashmir is apparently shifting. Rashid’s win symbolizes significant statement from the electorate. His son Abrar Rashid, highlighted the public’s support. He said “If four lakh people vote for my father it will send a message to every corner of India that my father is not a criminal. A criminal won’t get such a support.”
As legal proceedings continue, the political and legal communities are closely watching. They want to see if Rashid will be granted the opportunity to take his oath and participate in parliamentary duties. His case raises important questions about the intersection of legal issues and democratic mandates in India.
